The short version: Nimu is your business digital card inside a local directory. Businesses pay a subscription to be visible; browsing is free. Everyone owns their content and answers for it: Nimu is the platform, not the author. Sexually explicit content and sexual services are not allowed. You can leave whenever you want and your account gets truly deleted. The full details follow.
Nimu is an application and website operated by IBRSTUDIO LLC (Nimu, we, us). By creating an account you accept these Terms and our Privacy Policy, which is part of this agreement. If you do not agree, do not use Nimu.
This document exists in Spanish and English and both say the same. For users in Mexico the Spanish version governs; for everyone else the English version governs.
Nimu lets businesses and professionals create a public digital card with their information, links, photos, Google reviews, coupons, and a button to request quotes, inside a local directory ordered by distance and activity.
Nimu is a platform service: we publish content created by users, but we are not its author, we do not endorse it, and we are not a party to dealings between users and businesses.
You must be at least 13 years old to use Nimu, and at least 18, or the age of majority where you live, to purchase the business subscription. You agree to provide truthful information, keep your password safe, and not impersonate any person or business. You are responsible for all activity in your account.
Your card is visible in the directory only with an active subscription, purchased through the Apple App Store or Google Play at the price shown in the store at the time of purchase.
The content you upload (business name, description, photos, links, coupons) is yours. By publishing it you grant Nimu a worldwide, non exclusive, royalty free license to host, reproduce, and display it within Nimu, on our web pages, and in previews when shared, for as long as it remains published and for the reasonable time needed to operate backups.
You represent and warrant that you hold all rights to the content you publish, that your business information is truthful, and that your content does not infringe third party rights or any law. Your card is public by design: it can be viewed by anyone, shared, and found by search engines.
Content published by users and businesses belongs to its authors and reflects only their opinions and offers. Nimu does not verify, endorse, or guarantee the accuracy, quality, or legality of third party content. To the maximum extent permitted by applicable law, including Section 230 of the United States Communications Decency Act, Nimu is not responsible for content published by its users.
We respect intellectual property and expect the same from users. If you believe content on Nimu infringes your copyright or trademark, send a notice to soporte@nimuapp.app including: (1) identification of the protected work, (2) identification of the infringing content and its location on Nimu, (3) your contact information, (4) a good faith statement that the use is not authorized, and (5) a statement, under penalty of perjury, that the information is accurate and that you are the owner or the owner's agent, with your physical or electronic signature.
We will promptly remove qualifying content under the Digital Millennium Copyright Act (DMCA) and equivalent laws, notify the user who posted it, honor valid counter notices, and terminate the accounts of repeat infringers.
Businesses may publish up to 2 live coupons at a time, valid for a maximum of 30 days, a period that can only be shortened. Each coupon includes a redemption code.
A coupon is an offer made by the business, not by Nimu. The business defines its conditions, quantities, availability, and redemption method, and is solely responsible for honoring its offer and for its compliance with applicable advertising and promotion laws. Nimu only publishes the coupon and shows its metrics. Any claim about a coupon, including refusal to honor it, is resolved directly with the business.
When you request a quote, Nimu delivers to the business the message and the contact details you write, such as your name and phone number. The commercial relationship, prices, quality of work, and any later agreement are exclusively between the user and the business. Nimu is not a party to those dealings, does not guarantee them, and does not answer for them.
Ratings and reviews shown come from Google and belong to their authors. Nimu displays them as Google provides them, does not edit them, and does not answer for their content. The button to leave a review takes you to Google.
The to do tool lets you schedule reminders, messages, and emails. Scheduled emails are sent from an address on the Nimu domain showing your name, and replies go to your registration email.
By using this tool you represent that you have consent from, or a prior relationship with, each recipient, and you agree to comply with applicable anti spam laws, including CAN SPAM in the United States and its equivalents in Mexico. Regarding your recipients' data, you are the responsible party; Nimu only transmits your message at your instruction. Spam, prohibited content, and unsolicited bulk email are forbidden. Content goes through our moderation filter and abuse may result in suspension of the feature or the account.
The following is not allowed on Nimu in any form:
Legally operating adult businesses may advertise without explicit content.
Nimu may review, remove, or hide content and suspend accounts, but assumes no obligation to monitor all content. Moderation works like this: an automated filter reviews content when published; any user can report content, and reported content is hidden for the person who reported it; if several different users report the same content and a second automated review confirms it, it is hidden for everyone and the author is notified. These actions are taken in good faith and at our discretion. Suspension for violations does not generate a refund from Nimu; any refund is decided by the store under its policies.
You agree to indemnify and hold harmless IBRSTUDIO LLC, its owners, and its personnel from any claim, demand, damage, penalty, or expense, including reasonable attorney fees, arising from: (1) the content you publish, (2) your coupons, offers, and dealings with other users, (3) the emails you schedule and your recipients' data, (4) your violation of these Terms or any law, or (5) your infringement of third party rights. This obligation survives the closure of your account.
You can delete your account from the app at any time. It is deactivated immediately and stops being visible. You have 30 days to change your mind: if you sign in within that period, your account is reactivated with all its content. After 30 days, your account and your data are permanently deleted.
NIMU IS PROVIDED AS IS AND AS AVAILABLE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED AVAILABILITY, FREEDOM FROM ERRORS, OR COMMERCIAL RESULTS FOR YOUR BUSINESS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IBRSTUDIO LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, DATA, OR REPUTATION. THE TOTAL LIABILITY OF IBRSTUDIO LLC TO YOU IS LIMITED TO THE GREATER OF ONE HUNDRED DOLLARS (100 USD) AND THE AMOUNT YOU PAID TO NIMU IN THE 12 MONTHS BEFORE THE CLAIM. NOTHING IN THESE TERMS LIMITS RIGHTS THAT THE LAW OF YOUR PLACE OF RESIDENCE DECLARES NON WAIVABLE.
Before any formal action, write to soporte@nimuapp.app: most problems are solved by talking.
If not resolved, you and Nimu agree to resolve any dispute through individual, confidential arbitration administered by the American Arbitration Association under its consumer rules, in English or Spanish, which may be held remotely. BOTH PARTIES WAIVE TRIAL BY JURY AND PARTICIPATION IN CLASS OR REPRESENTATIVE ACTIONS. Exceptions: (1) qualifying claims in small claims court, and (2) actions to protect intellectual property.
You may reject this arbitration agreement by writing to soporte@nimuapp.app within 30 days of creating your account, stating your registration email and your decision to opt out; in that case disputes will be resolved in the courts described in section 19.
If you are a consumer in Mexico, nothing in this section limits your non waivable rights under the Federal Consumer Protection Law or your ability to go to PROFECO.
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law rules. For matters not subject to arbitration, the parties submit to the courts of El Paso County, Colorado. If you reside in Mexico or another country whose laws grant you additional non waivable rights, those rights remain intact.
You acknowledge that Apple and Google are not responsible for Nimu or these Terms; that their only obligations are those set by their own stores; and that Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you with respect to the app downloaded from its store. Maintenance, support, and any claim about the app belong to IBRSTUDIO LLC, not to the stores.
These Terms and the Privacy Policy are the entire agreement between you and Nimu. If any clause is found invalid, the rest remains in force. Our not enforcing a clause at a given time does not waive it. You may not assign this agreement; we may assign it within a reorganization or sale of the business, with notice to you. Nimu is not liable for delays caused by force majeure. Sections that by their nature should survive, including 5, 6, 14, 16, 17, 18, and 19, survive the closure of your account.
We may update these Terms. If a change is significant, we will notify you inside the app before it takes effect. Continuing to use Nimu after the notice means you accept the new version.
